These Terms govern your use of the Stockfluence service (the "Service"), operated by FUNALYSE LIMITED, a company registered in England and Wales (the "Company", "we", "us"). By creating an account or using the Service you agree to these Terms.
1. The Service
Stockfluence aggregates publicly available posts from financial commentators and uses automated analysis to surface sentiment, narratives, and pattern flags about publicly traded securities and digital assets. The Service is provided for general informational and educational purposes only.
We are not a broker, dealer, investment adviser, financial planner, fund manager, custodian, or any other regulated financial institution. We do not execute trades on your behalf, do not hold or custody customer funds or assets, do not provide personalised investment advice, and do not provide brokerage, exchange, or order-routing services.
2. Not financial advice
Nothing on the Service constitutes financial, investment, legal, tax or other professional advice, nor a recommendation, solicitation, or offer to buy, sell or hold any security or digital asset. Outputs โ including signals, sentiment scores, conviction levels, narratives, opportunity zones, outlooks, and voice leaderboard rankings โ are algorithmically derived from public social media activity and may be inaccurate, incomplete, out of date, manipulated, or unrepresentative.
We make no guarantee of investment performance. Past performance, modelled hit-rates, back-tested results, and any historical data shown on the Service are not indicative of future results. Use of the Service does not create a fiduciary, advisory, broker-client, or any other regulated relationship between you and the Company.
2a. User responsibility & risk
Trading and investing in securities, cryptocurrencies, and other financial instruments carries a high level of risk, including the risk of total loss of capital. You are solely responsible for your own investment decisions and for evaluating the merits and risks of any transaction. You should consult an appropriately qualified and regulated financial, legal, or tax adviser before acting on any information from the Service. By using the Service you acknowledge and accept these risks.
3. Eligibility & account
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You are responsible for keeping your credentials confidential and for all activity under your account. You must provide accurate information and keep it updated.
4. Acceptable use
You agree not to, and not to permit any third party to:
- use the Service unlawfully, fraudulently, or to facilitate spam, market manipulation, insider trading, or coordinated trading schemes;
- use outputs, signals, or aggregated data to provide regulated financial, investment, or advisory services to third parties;
- scrape, crawl, harvest, mirror, cache, or otherwise extract data from the Service by automated means, including via bots, scripts, or headless browsers;
- resell, sublicense, redistribute, syndicate, or commercially exploit the Service or its outputs, in whole or in part;
- reverse engineer, decompile, disassemble, or attempt to derive the source code, models, or training data of the Service;
- interfere with or compromise the security, integrity, or performance of the Service, including by introducing malware, probing for vulnerabilities, overloading infrastructure, or circumventing technical limits, rate limits, or paywalls;
- infringe intellectual property, privacy, publicity, or other rights of the Company or third parties;
- impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- share, transfer, or expose account credentials, or use a single account across multiple users or organisations;
- use the Service to generate, distribute, or amplify misleading, defamatory, harassing, or unlawful content about any company, security, or individual;
- misrepresent outputs of the Service as personalised financial advice, recommendations, or guarantees of investment performance.
We may investigate suspected violations and cooperate with law enforcement. Violations may result in immediate suspension or termination without refund.
5. Intellectual property
The Service, including its software, models, designs, branding and documentation, is owned by the Company and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to access and use the Service in accordance with your subscription.
6. Subscriptions, payments and refunds
Access to premium features requires a paid subscription. Subscriptions are billed by the Company through our third-party payment processor, Stripe. By subscribing you authorise recurring charges to your selected payment method until you cancel.
Pricing is shown at checkout in your local currency where available. Applicable taxes may be added at checkout. Refunds are handled in line with our Refund Policy. You can cancel future renewals at any time from your account.
7. User content
You retain ownership of any content you submit (for example, watchlist entries or feedback). You grant the Company a limited licence to host and process that content solely to provide the Service.
8. Warranties & liability
To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee uninterrupted or error-free operation.
To the fullest extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the fees paid by you in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, incidental or punitive damages, including loss of profits, data, goodwill, or investment losses. Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.
9. Indemnity
You agree to indemnify and hold the Company harmless against claims arising from your content, your use of the Service in breach of these Terms, or your unlawful conduct.
10. Suspension & termination
We may suspend or terminate your access for material breach, non-payment, security or fraud risk, or repeated or serious policy violations. On termination your right to access the Service ends; you may export your watchlist within a reasonable period before deletion.
11. Changes
We may update these Terms from time to time. Material changes will be notified through the Service or by email. Continued use after changes take effect constitutes acceptance.
12. Governing law
These Terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales, save where mandatory consumer protection laws of your country of residence apply.
